Terms and Conditions     Welcome to D'Anelli Printing & Publishing. This Web site is provided by D'Anelli Printing & Publishing Co. (referred to throughout this Web site as “D'Anelli Printing ”) as a service to our customers. Please review the following basic rules that govern your use of the D'Anelli Printing & Publishing Co. website. Please note that your use of the www.DanelliPrinting.com, www.TradeShowPrintShop.com sites (the "Site") constitutes your unconditional agreement to follow and be bound by these Terms and Conditions. Although you may "bookmark" a particular portion of this Site and thereby bypass this Agreement, your use of this Site still binds you to these Terms and Conditions. D'Anelli Printing reserves the right to update or modify these Terms and Conditions at any time without prior notice to you, and we encourage you to review these Terms and Conditions whenever you use this Site. Section A of these Terms and Conditions applies specifically to orders placed with D’Anelli Printing. Section B of these Terms and Conditions applies to all products and services available through the Site.   Section A Terms and Conditions of Order   The D'Anelli Printing & Publishing Co. Satisfaction Guarantee D'Anelli Printing & Publishing Co. stands behind the quality of its products and services. If you are not 100% satisfied with your purchase from us, simply contact Customer Service by phone at 702-76-PRINT(7-7468) within 30 days from the date you receive it (or the date it was scheduled to arrive), and we will reprint part or all of your order. In some cases, we may refund the full price of the product(s) in question, excluding shipping, postage and processing costs.   D'Anelli Printing & Publishing Co. is committed to customer satisfaction, and we do everything possible to ensure proper cutting, accurate color reproduction, and excellent D'Anelli Printing & Publishing Co. quality. However, certain circumstances are beyond our control and are not covered by this guarantee. Please note that we cannot be responsible for: ·          Spelling, punctuation, or grammatical errors made by the customer. ·          Inferior quality or low-resolution of uploaded or supplied images. ·          Design errors or color selection errors introduced by the customer in the artwork file creation process. For example color set to RGB vs. CMYK ·          Errors in user-selected options such product type, size, finishing options, or quantity. ·          Incorrect file dimensions, image orientation, or file submission in accordance with D'Anelli Printing & Publishing Co. specifications. ·          Damage to the products arising after delivery to the customer. ·          Duplicate orders by the customer. ·          Incorrect file layout for folding, scoring, hole-drilling, die cutting or other custom services. ·          Incorrect shipping address, undeliverable packages/3rd delivery attempts, or other errors created by the customer.  D'Anelli Printing & Publishing Co. will not ship to PO Box’s ·          This guarantee is also subject to a few other terms and conditions: ·          Full refund guarantee does not apply to shipping claims. We will reprint orders damaged or lost by UPS or other carrier of our choice. ·          We reserve the right to have you return the original order, at our cost, before re-printing or a refunding your order. ·          Maximum refund per order or customer is $2500. The only remedy for problems with orders over $2500 is a full or partial re-print by D'Anelli Printing & Publishing Co. of the order to correct product defects. ·          Color match, cutting and folding tolerances are guaranteed to be within industry standards (CMYK) for pleasing color and tolerances published within our website. ·          This guarantee is limited to reprint of the original order quantity or refund of the purchase price of the order. We are not responsible for any damages or claims incurred by you or your business caused by receiving printed materials which are defective or incomplete or which you receive later than the estimated delivery date. ·          This guarantee does not cover fees for mailing service or postage or associated incidental or consequential damages or claims. D'Anelli Printing & Publishing Co. is not liable for U.S. Postal Service errors, including loss or delay. Please preview your designs carefully and correct any issues prior to placing your order.   Payment   All prices and amounts shown on this Site are in U.S. Dollars (USD), unless otherwise noted. If a User submits a request on the Site to purchase D'Anelli Printing & Publishing Co. products, mailing services, design services or other services, the User agrees that all charges, taxes and shipping and processing fees will automatically be charged to the credit card or paid by User with an approved payment method. Such amounts will be posted on this Site.   Once a print job has been approved by customer and "sent to press" on the Site, no changes are allowed to the artwork files, job characteristics, or D'Anelli Printing & Publishing Co. turnaround time.   After a print job has been sent to D'Anelli Printing & Publishing Co.’s prepress department, the customer is responsible for paying the entire amount of that print job along with applicable taxes, shipping, and processing fees, unless otherwise noted. In some cases, a refund may be extended to the customer if no work has been done by D'Anelli Printing & Publishing Co. on that print job.   Please note that no work will proceed on any print job in your order until full payment is received by D'Anelli Printing & Publishing Co.   Payment Methods   All purchase requests must be submitted with an approved payment method unless otherwise expressly stated.   Approved payment methods include any of the following methods:   Pay by credit card via Pay Pal payment processing. This is simple and safe. Most of our customers pay this way. Our secure server scrambles your payment data so that only our computers can decode it. Pay by pre-pay, cash or check. Choose this option and finish your order. After you're done, we will instruct you on how to submit cash or mail your check to us. Pay on account. On account or purchase orders are available ONLY to government and educational institutions unless otherwise stated.   Our Sales Tax Policy   D'Anelli Printing & Publishing Co. is required to collect sales tax on purchases delivered or picked up within the state of Nevada and any states where we currently have physical business operations. For orders picked up or delivered in Nevada, tax is calculated based on the D'Anelli Printing & Publishing Co. and finishing product subtotal.   Tax-Exempt Individuals   If tax was charged on your order and you would like to claim tax-exempt status, you can request an adjustment for the amount of sales tax charged by sending in documentation of your tax-exempt status. Before or after placing your order through the Site, please fax a copy of your tax-exempt certificate along with your order number to the attention of the Credit department at: support@danelliprinting.com . After receiving your certificate, we will send you a confirmation Email.   Color Accuracy and Hardcopy Proofs   D'Anelli Printing & Publishing Co. will reproduce color from submitted print-ready files as closely as possible, but cannot exactly match color and density (as viewed in a 5000K light booth) because of limitations in the D'Anelli Printing & Publishing Co. process, as well as neighboring image ink requirements. The accuracy of each color reproduction (of the final printed product) is guaranteed to be within 90% of the final "hard-copy" proof you approved or D'Anelli Printing & Publishing Co. will reprint your job at no charge to the customer.   Please note that D'Anelli Printing & Publishing Co. cannot guarantee color reproduction for your print-ready files if you: (a) did not request a hardcopy proof; or (b) purchased a product that does not feature a hardcopy proof option. Please note that we accept no responsibility for color variations between submitted print-ready images and the actual artwork or product they represent. If you order a “Next Day Hardcopy” proof, your order must be placed, all files uploaded, and all files approved by 12:00 P.M. PST ( 3:00 P.M. EST ) in order for us to promise a next day delivery. If you order a “Next Day Hardcopy” Proof and you order is a booklet, catalog, newsletter or calendar product, our cut off time is 9am PST for these products. If you want more than one Hardcopy proof per job, we reserve the right to charge an additional $15 per page (for booklets and other multi-page products) or an additional $15 per proof (for all other products).   Artwork Files   Our prepress department checks most artwork files before printing, but you are still 100% responsible for the accuracy of your print-ready artwork files, and we encourage you to proof-read all files carefully before submitting to D'Anelli Printing & Publishing Co.   As postal regulations are subject to change, you are also 100% responsible for complying with current mailing restrictions for your layouts. Check with your local Post Office. Please note that we have created file preparation guidelines and product templates to assist you in creating print-ready files, and we also offer file preparation support services.   You certify that you have the right to use the image(s) in your artwork files. DO NOT send any "one-of-kind" transparencies, prints or artwork. Although we take every precaution to safeguard your materials, we are NOT responsible for loss or damage of images or artwork.   Under these Terms and Conditions, you agree that you will NOT upload any artwork files consisting of the following material: any material that could give rise to any civil or criminal liability under applicable law; and any material that could infringe rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights and the persons who are shown in the material if applicable. These requests will only be honored within 30 days of the order being received. ◊ Promotional codes MUST be entered at the time of the order. If there is no promotional code associated with an order, then it will be charged for the full amount. ◊ Promotional codes may not be used on custom jobs including custom sizes, materials, quantities, or quotes. ◊ Promotional code use is up to the discretion of management on a per-order basis.   ◊ By submitting your order for print, you agree that any and all files, artwork, creations, designs, ideas and concepts created physically or digitally may be used for marketing purposes such as video, photography, advertising and any other medium that DGI sees fit.    Production Times ◊ All production times listed on this website are our best estimate. ◊ Delays, while rare, may occur due to, but not limited, to the following reasons: equipment malfunction, internet outages, power outages, supplier delays, file problems, computer glitches, etc. ◊ We will not guarantee production shipping times to meet a deadline unless specifically requested by the customer who will then be verified by one of our representatives in writing. ◊ The estimated production time starts when your order is verified, files are deemed usable, and begins printing. ◊ The estimated production time does not start when you submit your order.   Shipping ◊ We are not responsible for lost or damaged packages. ◊ We will not give refunds for lost, damaged, or late packages. ◊ If your package is lost or late, we will file the necessary claim with our shipping company and re-print your order if necessary. ◊ If your package is damage beyond use, we will file the necessary claim our shipping company and re-print your order if necessary. ◊ All shipping times are our best estimate. ◊ Shipping fees are nonrefundable. ◊ Shipping delays may occur because of, but not limited to, the following reasons: weather delays, transit accidents, data errors, customs, vehicle malfunctions, etc. ◊ We do not guarantee any shipping times.   ◊ Import duties, taxes and custom charges are not included in the item price or shipping charges. These charges are the buyer's responsibility.   Returns ◊ You must contact us to receive an RMA number prior to returning your product. ◊ We do not accept unauthorized returns. ◊ Acceptable reasons for returns explicitly are: damaged product, product is no longer useable due to missing a mutually agreed upon deadline, received the wrong product, product has errors or missing elements. ◊ A return does not mean you will receive a refund. ◊ If you are seeking a refund or a re-print you must return your entire order to us. ◊ The RMA number must be written visibly on the outside of the package use to return the order.   ◊ Return shipping is the responsibility of the buyer. We will not reimburse any return shipping charges incurred.     Proofing/ Layout Service/ High Impact Custom Design   ◊ Layout and High Impact Custom Design fees are nonrefundable. Promos and discounts do not apply towards Layout and Design fees.  ◊ Proofing/Layout Service--You may make up to 3 revisions for free. Any subsequent revisions will result in a $10 charge per proof. ◊ High Impact Custom Design--You may make up to 5 revisions per design for free. Any subsequent revisions will result in a $10 charge per proof. ◊ High Impact Custom Design--You may request 2 design overhauls. Subsequent designs will result in a $30 charge per design. ◊ The Layout/High Impact custom design fees only pay for the labor that goes into creating the artwork. It does not pay for the copyright of the original artwork itself.   ◊ D'Anelli Printing & Publishing Co. retains the copyright of any designs created by its High Impact Custom Design service as well as the Layout Service. Artwork may be released to the customer at an additional payment amount upon mutual agreement.    File Submissions ◊ Orders containing non-ready to print files will be placed on hold until a ready to print file in the correct the file format is submitted. ◊ You must request a proof at the time of placing the order. Proofs cannot be sent after an order has started production. ◊ You may receive a proof, even if you didn't specifically request one, if we feel it is necessary before starting production. ◊ Colors in a digital proof are not guaranteed to match the finished product ◊ We cannot guarantee that the artwork will look exactly the same on your computer as it does on our equipment or the finished product. ◊ If the order details do not match the details of your submitted file(s) we will adjust the order details to match the file. In some cases this will cause a price change (increase or decrease) without notice. ◊ Please double check, revise, and fix any problems within your files before you submit your order. We are not able to make changes to your files once the order has entered production ◊ Files must be submitted in CMYK color format with no foreign or vendor specific color profiles embedded. ◊ If you submit a file in another color format, we will convert it to CMYK and exert our best effort to match colors. ◊ Color conversions may cause color shifting or files changes. ◊ We do not guarantee our CMYK colors will match the colors seen on your inkjet printer, your computer monitor, another printer, or any other Color Mode you specify. ◊ Files are generally kept on file for 3 years from last order.  We attempt to hold on to all files.  However, please keep in mind that files can be lost over the years due to many different factors (keeping track of Order Numbers will help and does expedite the process).   ◊ By submitting your order for print, you agree that any and all files, artwork, creations, designs, ideas and concepts created physically or digitally may be used for marketing purposes such as video, photography, advertising and any other medium that DGI sees fit.    Cancellations   ◊ If the order is cancelled after it has been processed, 20% of the cost of the order will be billed. ◊ If and order is processed and has begun printing, it may not be canceled ◊ If an order has been printed, pending shipping, and the customer no longer wants the order, paid shipping fees will be refunded.     ====================================================================================================   D'Anelli Printing & Publishing Co. Turnaround Time D'Anelli Printing & Publishing Co. turnaround time begins once your order has been placed and your print-ready files have been uploaded to our servers, attached to your print job, and proofs have been approved by you or D'Anelli Printing & Publishing Co.   If you ordered a next day hardcopy proof or standard hardcopy proof, D'Anelli Printing & Publishing Co. turnaround time begins when we receive approval for your proof. Please note that if we are unable to print your files because they do not conform to our file requirements, your job status will return to "Need Artwork" and your D'Anelli Printing & Publishing Co. turnaround time will be reset.   For print jobs that do not have complete digital source files provided, D'Anelli Printing & Publishing Co. turnaround begins when we have your print-ready file(s) for your print job, not from when the order is first submitted.   If your job or proof is approved by 9:00 A.M. PST ( 6:00 A.M. EST ), D'Anelli Printing & Publishing Co. turnaround time begins that business day.   For example: You choose a print job for “three-day” turnaround that you approved by 9:00 A.M. PST on Tuesday; it will be shipped out to you by end of business Friday.   Please note that D'Anelli Printing & Publishing Co. production departments are closed Saturdays, Sundays and Holidays. As a result, these days are not considered when calculating Printing turnaround time. In addition, D'Anelli Printing & Publishing Co. turnaround time does not include shipping transit time, and you should allow additional business days for delivery based on the shipping method you selected.   To qualify for same day printing turnaround time, your order must be placed, all files uploaded, and all files approved by 9:00 A.M. PST ( 6:00 A.M. EST ). If an order qualifies for same day D'Anelli Printing & Publishing Co. turnaround, it will be shipped out that day.   Note: Orders with same day printing turnaround placed on Saturdays, Sundays or Holidays will be processed on the next business day.   Printing turnaround time for jobs with approved payment and accepted print-ready files is guaranteed. The remedy for failing to meet a deadline is limited to a refund of any rush charges or a courtesy rush on your next order.   Cancellation of an order based on printing turnaround time is only allowed if the customer indicates in writing (e.g., note posted to order) when placing the original order that a job in the order is time sensitive and must be shipped by target date based on D'Anelli Printing & Publishing Co. turnaround option selected. Shipping   Unless you choose Pick Up or Mailing Services, you need to select one of the shipping options presented to you on the Site.   All shipping except Special COD is currently done via UPS.   When choosing a shipping option, please remember that the estimated shipping transit time is based on the number of business days in transit and does not include weekends, holidays or the day the package is picked up by UPS. For instance, a product shipped 2-Day Air and picked up on a Thursday would be delivered by end of day Monday.   For Special COD delivery (i.e., Air Cargo, Greyhound, or other shipping methods), there is a processing fee paid to D'Anelli Printing & Publishing Co. at time of purchase for making all necessary arrangements with the carrier. In addition, the customer pays the shipping charge at time of delivery. The Special COD shipping charge is set by the carrier, and orders shipped by COD must be picked up at the carrier’s location. Delivery to your door is not included or available when you select Special COD shipping options.   Shipping transit times vary, and D'Anelli Printing & Publishing Co. assumes no responsibility for delays caused by shipping carriers, weather or any damages resulting from the failure to receive a job on time. Your order may arrive late due to unforeseen delays in delivery service, the breakdown of equipment, illness, etc.   Pick Up orders will be held for 30 days at our facility. After 30 days, we will recycle your order.   You agree that shipping terms for all D'Anelli Printing & Publishing Co. products are shipped “Freight On Board Shipping Point” or “F.O.B. Shipping Point" – Title and Risk of loss transfers to you at time of shipment or pickup.   Target Arrival   Target arrival dates are calculated by adding the D'Anelli Printing & Publishing Co. turnaround time to the shipping transit time. If you are requesting a Hardcopy Proof, we already factor in additional time to reach your target date. For Standard Hardcopy Proof, expect approximately six business days to receive and approve your proof. For Next Day Hardcopy Proof, expect two business days. Both D'Anelli Printing & Publishing Co. and shipping times are based on business days only and do not include weekends or holidays. For example, a product with a D'Anelli Printing & Publishing Co. turnaround time of two business days and a shipping method of 2-Day Air would have a target arrival date four business days after your files have been received by us.   The cut off time for accepting files is 6:00 P.M. PST ( 9:00 P.M. EST ). If your files are in by that time, we will commit to D'Anelli Printing & Publishing Co. and shipping your product within the selected timeframe.   Please understand that target arrival dates are estimates, not guarantees. While we will do everything in our power to meet your target arrival date, weather and other occurrences beyond our control may impact our ability to meet that date.   Mailing Services   Customer's mailing list(s), while in the possession of D'Anelli Printing & Publishing Co., is the exclusive property of the customer and shall be used only with customer's instructions. Customer's mailing list(s) will not be sold or offered for use to any other party, and D'Anelli Printing & Publishing Co. will not utilize the list for any other purpose.   All mailing delivery dates are estimates, not guarantees. D'Anelli Printing & Publishing Co.’s responsibility is limited to preparing your mailing and completing delivery to the U.S. Postal Service (“USPS”). D'Anelli Printing & Publishing Co.’s responsibility ends when the job is delivered to the Las Vegas, Nevada Business Mail Entry Unit. In no event shall D'Anelli Printing & Publishing Co. be liable for USPS performance failures or delivery delays.   D'Anelli Printing & Publishing Co. shall be liable to rectify printing and mailing errors only to the extent of re-mailing a correction or corrected job as soon as possible, and allowable damages shall be limited to the value of the D'Anelli Printing & Publishing Co. work performed. In no case is D'Anelli Printing & Publishing Co. liable for loss of business; incidental or consequential damages; or costs in excess of billing for services related to the specific job.   The customer will defend and hold D'Anelli Printing & Publishing Co. harmless in any suit or court action brought against D'Anelli Printing & Publishing Co. by others for alleged damages, costs, expenses (including reasonable attorney's fees), liabilities or losses resulting from circumstances where D'Anelli Printing & Publishing Co., acting as the customer's agent, uses copy, photographs, or illustrations that are believed by others to be degrading, libelous or harmful to their reputations, images, or standing in the community or which in D'Anelli Printing & Publishing Co.’s sole judgment is an infringement on a trademark, or trade name, or service mark, or copyright belonging to others, or in a suit or court action brought against D'Anelli Printing & Publishing Co. for actions of the customer's employees which may occur as a result of any mailing.   Mailing lists purchased by the customer through D'Anelli Printing & Publishing Co. are non-refundable.   Miscellaneous   All sales are final, unless otherwise noted.   No refunds are given once D'Anelli Printing & Publishing Co. begins working on your order, which means D'Anelli Printing & Publishing Co. has received your necessary materials (i.e., digital files and payment) and started work on your job (i.e., your job is in production).   Within 30 days of purchase, a partial or full refund may be extended to the customer if no work has been completed by D'Anelli Printing & Publishing Co.   Please note that such refund would be reduced to cover any fees charged for proofs, processing or other services associated with that order.   To be sure we are successful at meeting customer-requested turnaround times; D'Anelli Printing & Publishing Co. actively maintains materials inventory and staff, and schedules time on all equipment for orders that have been placed. Orders that are not sent to press by the customer within 5 days of order incur additional equipment, labor and inventory costs for D'Anelli Printing & Publishing Co. Orders not sent to press by the customer within 90 days of the order being placed will be non-refundable and will incur a fee of 12.5% of the original job total for each 30 day period thereafter until 100% of the original job total has been accrued in fees.   All materials we create in producing your printed product are the property of D'Anelli Printing & Publishing Co. Although these materials will NOT be sold or given to any other party, we reserve the right to distribute free samples of your printed product(s). Please note that your printed product(s) or images used for your printed product(s) will not be used in any national advertising without your prior written consent.   Section B General Terms and Conditions   Copyright Notice   You, the User, acknowledge that all content included on this Site, including, without limitation, the information, data, software, photographs, graphs, typefaces, graphics, images, illustrations, maps, designs, icons, written and other material and compilations (collectively, "Content") are intellectual property and copyrighted works of D'Anelli Printing & Publishing Co. and/or various third-party providers ("Providers"). Reproductions or storage of Content retrieved from this Site, in all forms, media and technologies now existing or hereafter developed, is subject to the U.S. Copyright Act of 1976, Title 17 of the United States Code.   Corporate Identification and Trademarks   D'Anelli Printing & Publishing Co.,  www.DanelliPrinting.com  ,  www.TradeShowPrintShop.com  and any and all other trademarks appearing on this Site are trademarks of D'Anelli Printing & Publishing Co. in the United States and other jurisdictions ("Trademarks").
